Terms of Service

Please read these Terms of Service carefully before using the Hungry Hunter Gaming platform. By accessing or using our platform, you agree to be bound by these terms. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

1. Acceptance of Terms

By accessing, browsing, registering for, or using the Hungry Hunter Gaming website and platform at hungryhuntergaming.com (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy, all of which are incorporated herein by reference.

If you do not agree to these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated via a notice on our Platform, and your continued use following such notice constitutes acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you and Hungry Hunter Gaming. If you are using the Platform on behalf of an organization, you represent and warrant that you have authority to bind that organization.

2. Platform Description

Hungry Hunter Gaming is a free, fantasy-themed social arcade entertainment platform designed exclusively for Canadian adults aged 19 and over. Our Platform offers interactive browser-based games, including Troll Hunter Expedition, for entertainment purposes only.

Important: Hungry Hunter Gaming is purely a social entertainment service. No real money, currency, or items of monetary value are collected, wagered, won, or distributed on this Platform at any stage. Virtual points, credits, or scores earned within our games have no monetary value, cannot be exchanged for real money or prizes, and cannot be transferred outside the Platform.

We offer the Platform as a service to registered users at no charge. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice or liability.

3. Eligibility

To use Hungry Hunter Gaming, you must meet all of the following criteria:

  • You must be at least 19 years of age.
  • You must be a resident of Canada.
  • You must have the legal capacity to enter into binding agreements.
  • You must not have been previously suspended or banned from our Platform.
  • Your use must comply with all applicable federal and provincial laws.

By using the Platform, you represent and warrant that you meet all of the above requirements. If we discover that you do not meet these requirements, we reserve the right to immediately terminate your access and delete your account without notice.

The age of majority in most Canadian provinces and territories is 18; however, we have set our minimum age at 19 out of an abundance of caution to align with provinces including British Columbia, New Brunswick, Newfoundland and Labrador, Nova Scotia, and Prince Edward Island.

4. Your Account

To access certain features of the Platform, you may be required to create an account. When creating your account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information to keep it accurate and current.
  • Keep your password confidential and not share it with any third party.
  • Notify us immediately at hello@hungryhuntergaming.com if you suspect unauthorized access to your account.
  • Be responsible for all activity occurring under your account.

You may not create more than one account per person. We reserve the right to refuse registration, cancel accounts, or remove content at our sole discretion.

5. Acceptable Use

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict their enjoyment of the Platform. Specifically, you must not:

  • Use any automated system, bot, scraper, or script to access the Platform without our prior written consent.
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or computer systems connected to the Platform.
  • Transmit any viruses, worms, malware, or other harmful code.
  • Harass, threaten, impersonate, or intimidate other users or our staff.
  • Post or transmit any content that is defamatory, obscene, fraudulent, hateful, or that infringes intellectual property rights.
  • Reverse engineer, decompile, or disassemble any part of our Platform.
  • Use the Platform for any commercial purpose without our express written consent.
  • Circumvent age-verification or geographic-restriction mechanisms.
  • Engage in any activity that disrupts or degrades the performance of our servers or networks.

Violation of this section may result in immediate account termination, and we reserve the right to refer violations to law enforcement authorities where appropriate.

6. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, game assets, software code, and the overall design and arrangement of the Platform ("Content"), is owned by or licensed to Hungry Hunter Gaming and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial entertainment purposes only. This licence does not include the right to:

  • Reproduce, distribute, or publicly display any Content.
  • Modify or create derivative works based on any Content.
  • Use any Content for any commercial purpose or for any public display.
  • Remove or alter any copyright, trademark, or other proprietary notices.

The Hungry Hunter Gaming name, logo, and all related names, logos, product and service names, and slogans are trademarks of Hungry Hunter Gaming. You may not use such marks without our prior written permission.

7. User Content

If you submit, post, or transmit any content to the Platform ("User Content"), including usernames, chat messages, or feedback, you grant Hungry Hunter Gaming a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, and distribute such User Content in connection with operating and improving the Platform.

You represent and warrant that your User Content does not violate any applicable law or any third party's rights. You retain ownership of your User Content, but acknowledge that we have no obligation to maintain, store, or make it available.

We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms, is offensive, or is otherwise inappropriate, without prior notice.

8. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, timely, secure, or error-free.
  • Results obtained from use of the Platform will be accurate or reliable.
  • Any defects in the Platform will be corrected.

Some jurisdictions do not allow certain disclaimers, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY ONTARIO LAW AND APPLICABLE CANADIAN LAW, HUNGRY HUNTER GAMING AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED FIFTY CANADIAN DOLLARS (CAD $50.00) OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. SINCE THE PLATFORM IS PROVIDED FREE OF CHARGE, OUR LIABILITY IS LIMITED TO CAD $50.00.

The limitations in this section apply whether the alleged liability is based in contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hungry Hunter Gaming and its directors, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms.
  • Your use of the Platform, including any User Content you submit.
  • Your violation of any applicable law or regulation.
  • Your infringement of any third party's rights.

We reserve the right, at our expense, to assume exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of such claims.

11. Termination

We may suspend or terminate your access to all or part of the Platform immediately and without prior notice if we reasonably believe you have breached these Terms, engaged in fraudulent or illegal activity, or if we cease to operate the Platform.

You may close your account at any time by contacting us at hello@hungryhuntergaming.com. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 6, 8, 9, 10, and 12.

12. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any legal action or proceeding relating to these Terms or the Platform shall be brought exclusively in the courts of competent jurisdiction in Ontario, Canada. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in Ontario.

Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may seek relief from the appropriate Ontario courts.
